Apple Computer, Inc. v. Microsoft Corporation, 35 F.3d 1435 (9th Cir. 1994) was a copyright infringement lawsuit in which Apple Computer, Inc. (now Apple Inc.) sought to prevent Microsoft Corporation and Hewlett-Packard from using visual graphical user interface (GUI) elements that were similar to those in Apple’s Lisa and Macintosh operating systems. The court ruled that, “Apple cannot get patent-like protection for the idea of a graphical user interface, or the idea of a desktop metaphor [under copyright law]…”[1] In the midst of the Apple v. Microsoft lawsuit, Xerox also sued Apple alleging that Mac’s GUI was heavily based on Xerox’s.[2] The district court dismissed Xerox’s claims without addressing whether Apple’s GUI infringed Xerox’s.[3] Apple lost all claims in the Microsoft suit except for the ruling that the trash can icon and file folder icons from Hewlett-Packard’s NewWave windows application were infringing. The lawsuit was filed in 1988 and lasted four years; the decision was affirmed on appeal in 1994,[1] and Apple’s appeal to the U.S. Supreme Court was denied.

O multime de oameni cu idei si inventii noi pierd startul antreprenorial ramanand in urma si privind la sprintenul vanzator care le-a preluat ideea si a facut bani din ea.
De asemenea o multime dintre acestia sunt dintre cei care pretind a fi primii care au avut ideea, nu este de ajuns sa ai primul ideea, trebuie sa fi si primul care o pui in fuctiune.
Povestea sistemului de operare cu ferestre Windows este similara cu fabula Vulpea si Corbul, Apple s-a laudat prea tare cu tehnologia sa noua iar Microsoft a “papat cashcavalul”.
Degeaba apoi Apple a dat in judecata Microsoft, Apple a pierdut cota piata, calculatoarele au luato pe drumul IBM compatible, Microsoft dintr-o corporatie de 100 milioane $ si-a inmiit valoarea (100 miliarde) iar Apple de dorul celor 150 milioane $ despagubire a pierdut sutele de miliarde.
Morala a fost ca de multe ori “daraua e mai mare ca paraua” si mai bine eviti sa mergi la judecati decat sa iti cauti profiturile in despagubiri, la inceputul mileniului 3, iPod-ul a dat prima gura de aer companiei Apple, apoi procesorul G3, Macbook-ul colorat, apoi cu discretia si finetea sa iPhone-ul a consolidat pozitia Apple.
Microsoft ramasa fara inovatii breakthrough stationeaza spre declin, Apple lanseaza inovatie dupa inovatie, noul browser Safari fiind imediat imitat, layout-ul minimalist, bara de instrumente discreta fiind naturalizata chiar si de catre Google.
Apple totusi nu renunta la ermetism, mp3-ul, Quick Time-ul, iTunes si toate celelalte cu tot exotismul esoteric ii limiteaza profiturile.
Oare va rezista Apple anii ce vor urma asaltului noului concurent openminded pe nume Google?
Deocamdata iPad este un posibil esec pe care altii l-au transformat in succes.
